There are several things to think about when you are considering a patent for your product. In the USA we have "Utlility Patents" and "Design Patents"

The utility patent protects a new invention or improvements on existing inventions which are functional. Utility patents are issued to any functional new inventions or improvements on a machine, process, product or to the composition of matter.

A design patent is a form of intellectual property protection which allows an inventor to protect the original shape or surface ornamentation of a useful manufactured article.
There is a big difference in that a design patent only protects the aesthetics of the product and can be easily beaten by competitors who simply change the shape. Design patents are much cheaper to obtain though and may be all you need.
